1. What this policy covers

Lubbih hosts material that merchants, brands, and creators upload or submit: deal photographs, campaign images, account avatars, List content, and Goods submissions. Lubbih does not review that material before it appears.

Lubbih respects the intellectual property of others. If you own a copyright in material that appears on Lubbih and it was posted without your permission, you may send a takedown notice using the process below, and we will act on it.

2. Designated agent

Notices sent to any other address may be delayed. Use this contact only for copyright matters; unrelated messages will not receive a response here.

3. What a takedown notice must contain

To be effective under 17 U.S.C. 512(c)(3), your notice must include substantially all of the following:

• A physical or electronic signature of the copyright owner, or a person authorized to act on the owner's behalf
• Identification of the copyrighted work you claim was infringed (or a representative list, if several works on Lubbih are covered by one notice)
• Identification of the material you say is infringing, with enough detail for us to find it — a Lubbih URL is best
• Your name, mailing address, telephone number, and email address
• A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner's behalf

4. What Lubbih does with a notice

On receiving a notice that substantially complies with the requirements above, we will expeditiously remove or disable access to the material, notify the user who posted it, and give that user a copy of the notice.

We may also record a copyright strike against the account that posted the material.

5. Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the agent above. It must include your signature, identification of the removed material and where it appeared, and a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.

A counter-notice must also include your name, address, and telephone number, and your consent to the jurisdiction of the federal district court for the judicial district where you live (or, if you live outside the United States, any judicial district in which Lubbih may be found), and that you will accept service of process from the person who sent the original notice.

If we receive a valid counter-notice we will forward it to the original complainant. Unless they file a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.

6. Repeat infringers

Lubbih terminates, in appropriate circumstances, the accounts of users who are repeat infringers. An account that accrues 3 unresolved copyright strikes is suspended, its listings and submissions are withdrawn from the marketplace, and any pending payout is held pending review.

A strike is withdrawn if the notice that produced it is retracted, or if a counter-notice is sent and the complainant does not file a court action within the statutory window.

7. Misrepresentation

Under 17 U.S.C. 512(f), anyone who knowingly and materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys' fees. Do not send a notice unless you are confident you hold the rights you are asserting.
